O R D E R

% 04.04.2016 This is a petition under Section 482 of Cr.PC moved by the petitioner for quashing of FIR No. 162/2013 under Section 354A/509 IPC registered at Police Station Keshav Puram, Delhi on the ground of settlement. It is submitted by counsel for the petitioner that the matter has been settled between the parties before Mediation Centre, Rohini Courts, Delhi on 13.01.2015 as well as the matter has also been settled against the family members of the petitioner in case FIR No.593/2014 Police Station Keshav Puram, Delhi. As per the settlement all the cases which are pending before the Court shall be withdrawn by the respondent no.2. The respondent No.2/complainant, who is present in person (duly identified by the Investigating Officer of the case) submits that the petitioner is her brother-in-law and she has settled the dispute out of her own free will and has no objection to quashing of instant FIR.

Mr Hirein Sharma, Additional Public Prosecutor for the State opposes the petition on the ground that the trial is at fag end as all the prosecution witnesses have already been examined.

Keeping in view the facts that the parties are close relations as the petitioner is brother-in-law of respondent No.2. There was matrimonial discord between the

respondent and her husband which have also been settled and now they are living together. Further respondent No. 2 has now settled her dispute with petitioner, as such, in larger interest, it will be desirable that this matter should be given a quietus as continuance of proceedings arising out of the FIR in question may cause hindrance in the matrimonial life of respondent No.2.

Accordingly, the petition is allowed and the FIR No. 162/2013 under Section 354A/509 IPC registered at Police Station Keshav Puram, Delhi and consequent proceedings emanating therefrom are hereby quashed subject to payment of Rs.20,000/- as costs which be deposited by the petitioner with Delhi High Court Staff Welfare Association within four weeks from today. Copy of receipt of deposit of cost be placed on record.

The petition stands disposed of accordingly.
