O R D E R

% 26.02.2019 Vide the present petition, the petitioner seeks direction thereby setting aside order dated 19.11.2015 by the respondent No.1 whereby the regularisation of post TXR/JE, (C&W) promotion with consequence pensionary benefits.

The case of the petitioner is that he was initially appointed as Khalasi on 28.06.1961 and promoted to Fitter in the year 1994. At the time of appointment, he filed an affidavit stating his date of birth as 15.05.1941. He was asked to file some documents to prove the date of birth. Then, he filed the School Leaving Certificate wherein his date of birth was recorded as 04.06.1943 and accordingly his age was continued in the office record of the respondents as 04.06.1943. However, keeping in view the date of birth of the petitioner as 15.05.1941, he was forced to retire in the year 2001. Admittedly, the petitioner has filed the present petition in the year 2017 whereas he was retired in the year 2001.

In my view, there is inordinate delay in filing the petition, thus, the present petition suffers from delay and latches, accordingly, the same is dismissed.
