% 05.10.2016 This is a petition under Section 482 Cr.P.C. filed on behalf of the petitioners praying for quashing of FIR No.315/2001, under Section 63 of the Copyright Act read with Sections 78 & 79 of the Trade Marks Act, registered at Police Station Kalkaji, Delhi and all consequential proceedings arising therefrom.

Learned counsel for the petitioner submits that there were two accused persons Suresh Kumar and Harish Puri and he further submits that petitioner, Suresh Mohan has already been expired on 07.02.2003 in a road accident and proceedings has been abated against him. Learned counsel for the petitioner further submitted that present petitioner has enters into the settlement with the respondent No.2/AR of M/s

Logitech International SA. The settlement agreement dated 04.06.2011 is placed on record. He also submits that FIR No. 315/2001 under Section 63 Copy Right Act 1979 and 78/79 of the Trade Mark Act and 420 /485/482/486 IPC.

Respondent No.2/AR of M/s Logitech International SA is present in court today and he is identified by the Investigating Officer. Respondent No.2/AR of M/s Logitech International SA also admits the execution of the settlement deed dated 04.06.2011 and he has no objection if the aforesaid FIR No. 315/2001 be quashed and further confirmed that the agreement reached between the parties is without coercion, pressure and the same is volunteered.

In view of the aforesaid facts and circumstances, to meet the ends of justice FIR No. 315/2001 under Section 63 Copy Right Act 1979 and 78/79 of the Trade Mark Act and 420 /485/482 IPC stands quashed. The present petition is according disposed of. I.S.MEHTA, J OCTOBER 05, 2016 b
