BAIL APPLN. 2528/2017 On the last date of hearing i.e. 12.12.2017, this Court had directed that coercive measures would not be taken against the petitioner provided he deposits an amount of Rs.22.5 crores. At the request of the petitioner the deposit was permitted in three equal instalments of Rs. 7.5 crores each to be made on the 15th, 21st and 30th December, 2017. The first amount has not been deposited.
There is no application seeking extension of time for making the said deposit nor for explaining the reason for failure to comply with the directions. The petitioner is in breach of the conditions imposed by
the Court granting him the interim protection. Evidently, the process of the Court has been misused for enjoying the interim protection. In the circumstances, the interim protection is vacated. At this stage, the learned counsel for the petitioner seeks to withdraw the bail application.
It is dismissed as withdrawn in the aforesaid circumstances.
