After addressing arguments at some length, assailing the order dated 9th October, 2017, passed by the Tribunal, whereunder the Original Application filed by the petitioner for grant of VRS, has been rejected on the ground that a departmental inquiry against him had commenced on 11th August, 2014 and the memo of charges stood served on him on 20th March, 2015, learned counsel for the petitioner states that as the counsel for the respondents has informed him in Court that out of two departmental inquiries initiated against the petitioner, one stands concluded and a report has been submitted by the inquiry officer to the disciplinary authority, he may be permitted to withdraw the petition while reserving the right of the petitioner to seek legal recourse as and when notice to show cause is issued to him on the basis of the report of the disciplinary inquiry sent to him. The petition is dismissed as withdrawn with liberty granted as prayed for.
