After arguments, the appeal is disposed of with the consent of the parties by setting aside the judgement dated 16.11.2017, however making it clear that none of the parties will unnecessarily seek adjournments in the suit and if unnecessary adjournments are sought, the same can be burdened by the Trial court with heavy costs. It is also agreed that each of the parties will not take more than three opportunities to complete the cross-examination of the witnesses of the other side, with each cross-examination of being of one hour at least.

Accordingly, while setting aside the impugned judgment dated 16.11.2017, parties are directed to appear before the District & Sessions Judge, South West district, Dwarka, New Delhi-110003 on 2nd May, 2018 and the District & Sessions Judge will mark the suit for

disposal to a competent court in accordance with law or the court which passed the impugned judgment dated 16th November, 2017. 3.

The trial court is requested to expedite the disposal of the suit. Dasti to counsels for the parties.
