O R D E R

% 08.12.2017 Learned counsel for the petitioner submits that prosecutrix is aged about 29 years of age. She is a grown up lady. Petitioner is aged about 26 years. Petitioner and the prosecutrix fell in love. They had visited several places including Agra.

Several photographs have been placed on record. Their relationship broke only thereafter, prosecutrix has alleged that petitioner had established physical relations with her on the pretext of marriage.

Learned counsel for the petitioner further submits that veracity of the version of prosecutrix will be tested during the trial. Petitioner had not promised to marry the prosecutrix.

Learned APP has opposed to grant the anticipatory bail to the

petitioner. She has contended that petitioner established physical relations with the prosecutrix by extending promise to marry her and their marriage was also fixed.

Talks of marriage also took place. However, later on, petitioner's family backed out on the pretext that prosecutrix belonged to a poor family and will not be able to fulfil their demands. Keeping in mind the totality of facts and circumstances as detailed above, it is ordered that in case of arrest, petitioner be released on anticipatory bail subject to his furnishing a personal bond in the sum of `25,000/-(Rupees Twenty Five Thousand Only) with one surety of the like amount to the satisfaction of the Investigating Officer/Arresting Officer/SHO concerned.

Bail application is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
