% 15.02.2019 This order may be read as the order dated 30.01.2019. The learned counsel for the petitioner submits there are no dues which the petitioner has to pay to the respondent no.2 and in any case if there is any issue raised qua the dues, the respondent no.2 can avail an alternate remedy in this regard.
Admittedly since the year 2008 the respondent No. 2 has ceased to be in service of the petitioner and thus has no right to occupy the same and as such the proceedings under the Public Premises (Eviction of Unauthorised Occupants) Act, 1971 were initiated and his appeal dismissed on 25.02.2010. The petitioner need to execute the order of eviction passed by the Estate Officer on 08.09.2009. The respondent no. 2 says he would vacate the premises on or before 15.04.2019 and
handover its peaceful possession to the petitioner. In case he fails the respondent no.1 to provide the police aid to the petitioner for 16.04.2019. There is nothing else is to be done in this petition. The petition stands disposed of, pending applications if any, also stands disposed of in terms of above.
