O.M.P. (E) (COMM.) 25/2017 This application under Section 27 of the Arbitration and Conciliation Act, 1996 has been filed by the petitioner seeking assistance of this Court to summon the witness with the documents mentioned herein below before the Sole Arbitrator who is adjudicating the disputes between the parties. As the Sole Arbitrator has already granted the permission to the petitioner to summon the said witness through the assistance of the Court vide his order dated 14.10.2017 read with order dated 14.11.2017, I do not see any necessity to issue notice of the petition to the respondent.

Accordingly, I direct issuance of summons to the concerned and competent official or clerk from the Centralised Processing Cell-

TDS, Income Tax Department, Government of India, Aayakar Bhawan, Sector- 3, Vaishali, Ghaziabad, Uttar Pradesh-201010, directing him/her to appear and produce the record pertaining to Form 26AS (Annual Tax statement under Section 203AA of the Income Tax Act, 1961) of NS Interior Contracts Pvt.

Ltd.

(PAN No.AADCN5614M) for the Financial Year 2011-12 (Assessment year 2012-13) and Financial Year 2012-13 (Assessment year 2013-14), duly certified under Section 65B of the Indian Evidence Act, 1872, and give evidence before the Sole Arbitrator, Justice Anil Kumar (Retd) on 20.01.2018 at 12.00 p.m. at B-33, Panchsheel Enclave, New Delhi-110017.

The diet money for the witness shall be paid on his appearance before the Sole Arbitrator.

The petition is allowed in the above terms.
