% 01.02.2018 Learned counsel for the petitioner submits that in the MLC, prosecutrix has not levelled any allegation of rape against the petitioner. The history was given by her to the doctor. As per the MLC, prosecutrix was assaulted by her father ten days back. In the FIR, prosecutrix stated that the petitioner sexually assaulted her ten days ago from registration of FIR;
meaning thereby that petitioner had allegedly raped the prosecutrix on 20th March, 2017. In her statement under Section 164 Cr.P.C.
recorded on 6th April, 2017, prosecutrix stated that petitioner had raped her two days ago. Learned counsel for
the petitioner submits that petitioner is in custody for about ten months. Prosecutrix has already been examined. Petitioner may be admitted to bail. Learned APP has opposed the grant of bail to the petitioner. Keeping in mind the totality of the facts and circumstances of this case, petitioner is admitted to bail, subject to his furnishing a personal bond in the sum of `20,000/- (Rupees Twenty Thousand Only) with one surety in the like amount to the satisfaction of the trial court.
