IN THE HIGH COURT OF DELHI AT NEW DELHI

+ W.P.(C) 88/2018 HARSHAL GRAMIN VIKAS BAHU SANSTHA ..... Petitioner Through:

Ms Deeksha Mishra and Mr Rohan Sharma, Advocates.

versus UNION OF INDIA AND ORS ..... Respondents Through:

Mr Ajay Digpaul, CGSC with Mr Satnosh Kumar Pandey, Govt.

Pleader and Ms Madhuri Dhingra, Advocate for R-1 to R-5.

CORAM:

HON'BLE MR. JUSTICE VIBHU BAKHRU

O R D E R

% 05.01.2018 CM No.396/2018 1.

Allowed, subject to all just exceptions.

W.P.(C) 88/2018 & CM No.395/2017 2.

The petitioner has filed the present petition, inter alia, impugning a communication dated 05.09.2017 terminating the contract dated 10.09.2015, whereby the petitioner was engaged to provide services as a consultant. It is the petitioner's case that the termination is wrongful and illegal. The petitioner further claims that the respondents owes a sum of `2.4 crores on account of work already done in terms of the contract and seeks recovery of the said amount along with the interest of 18% p.a. 3.

It is apparent from the above that the disputes sought to be raised by the petitioner are contractual disputes and would involve several questions

of fact.

In this view, this Court is not persuaded to entertain the present petition. The petition alongwith the application is, accordingly, disposed of with liberty to the petitioner to institute appropriate proceedings in accordance with law.
