O R D E R

% 19.11.2015 Learned counsel submits that the impugned order of learned Single Judge cannot be sustained as it directed release of amounts without due verification. It is submitted that the application I.A. No. 9352/2014 in CS (O.S) No. 1344/2012 pending on the file of the learned Single Judge seeks modification of a previous interim order and in the circumstances, without due verification, the defendant/appellant should not have been directed to reimburse substantial amounts-to the tune of Rs. 1,30,000/-. This Court notices that the orders complained of direct payment of adhoc interim amount. This would in the normal circumstances be subject to the final outcome and treated as adhoc payment. In the

circumstances, if the appellant is aggrieved that the amounts directed are excessive or unfounded for any reason. It is open to him to urge the same before the learned Single Judge. In such circumstances, the learned Single Judge would take due note of the contentions of the parties.

The appeal is disposed of in the above terms. Order dasti.
