O R D E R

% 16.07.2018 Aggrieved by the judgment dated 16th March, 2016, acquitting the respondent for offences punishable under Section 138 of the Negotiable Instruments Act, the petitioner preferred the Leave to Appeal petition before this Court wherein leave to appeal was granted vide order dated November 30, 2017. Pending hearing, in the present Criminal Appeal, parties have settled the matter. Respondent has discharged his liability towards the appellant by paying a total sum of ₹3,40,000/-. ₹1,75,000/- were handed over to the appellant by way of a demand draft on 16th April, 2018 and the balance amount of ₹1,65,000/- has been handed over by way of a demand draft today in Court.

Appellant, who is present in Court and is identified by learned counsel, seeks leave to withdraw the appeal.

Appellant further states that since the parties have settled the matter and the appellant has been paid in discharge of the liability, he would also withdraw his Execution Petition filed against the decree dated 20th July, 207 passed by the learned Civil Judge, Karkardooma Court. Appeal is thus dismissed as withdrawn.
