CORAM:

HON'BLE MS. JUSTICE INDERMEET KAUR

O R D E R

% 05.01.2018 Petitioner is seeking parole for reasons as mentioned in the petition. There are primarily two reasons. The first is to search a suitable girl for his son who is of marriageable age; to get his damaged house repair and to re-connect himself with society. On advance notice, learned counsel for the State has appeared and filed a status report. It is pointed out that the son of the petitioner is aged 24 years and is in fact not living in the house of the petitioner; he is living in Bangalore with his sister. The house of the petitioner also appears to be in a fairly good condition. Petitioner had been granted furlough with effect from 12.06.2017 to 26.06.2017. This Court notes that the petitioner is convict under Section 376/506/354 IPC. The maximum sentence

awarded to him is RI for 10 years besides fine. Petitioner has undergone sentence of more than 8 years. Petitioner had not misused the furlough which had been granted to him on last date which was for a period of two week. The competent authority had rejected the prayer of the petitioner on 21.08.2017 noting that the petitioner had recently availed furlough with effect from the aforenoted dates. The nominal roll of the petitioner reflects the conduct of the petitioner to be satisfactory.

The petitioner be admitted to parole for a period of two weeks from the date of his release on the following terms and conditions: (i) He shall furnish his personal bond in the sum of Rs. 20,000/- with two sureties in the like amount, out of them one shall be local surety, to the satisfaction of the concerned Jail Superintendent.

(ii) The petitioner shall maintain good conduct and behaviour during his release.

(iii) He will provide on mobile number of both the sureties to the SHO of the concerned Police Station, which shall be kept in active mode and shall not be changed without permission of the Court.

(iv) He shall report to the SHO, PS Mehrauli, Delhi once a week on every Monday.

(v) He shall not leave the National Capital Territory of Delhi within the aforenoted period.

(vi) He will give his address and mobile number to the local SHO.

Petition disposed of.

Copy of this order be sent to the Jail Superintendent for intimation of the order.
