The petitioner by this petition had impugned the interim order dated of the appellate court. Learned counsel for the petitioner submits that the Court had finally disposed of the petition vide judgment dated 22.01.2018 and the present petition has become infructuous. Copy of the judgment dated 22.01.2018, has been produced and taken on record. 2.

Since the petitioner had succeeded before the appellate court, the amount of Rs. 10 lakhs deposited by the respondent in terms of order dated 12.12.2017, be released to the petitioner along with accrued interest, if any, thereon. The respondent shall get due credit for the said amount before the trial court.

In view of the above, learned counsel for the petitioner seeks leave to withdraw the petition.
