O R D E R

% 12.03.2018 After some hearing, the counsel for the respondent/plaintiff concedes that the petition may be allowed and the petitioner/defendant may be granted renewed opportunity for crossexamination of the witness (PW-1), the costs imposed by earlier order having been waived subject, however, to the insistence that suitable directions be given so that the renewed opportunity does not lead to prolonged proceedings.

The counsel for the petitioner submits an undertaking that he would appear on the call of the case on the appropriate date fixed and have due instructions taken in advance from the petitioner who is in judicial custody and would complete the cross-examination availing the opportunity on the date which is tendered. Binding the petitioner with the undertaking given on her behalf, the petition is allowed.

The impugned order closing the right of cross-examination of the petitioner qua PW-1 is set aside. CM(M) 20/2018

The trial court will fix an appropriate date on which the petitioner through her counsel would carry out the cross-examination. The petition and the application stand disposed of in above terms.
