CORAM:

HON'BLE MR. JUSTICE NAVIN CHAWLA

O R D E R

% 12.12.2017 IA No.14786/2017 (Exemption) Allowed, subject to all just exceptions.

OMP (ENF.) (COMM.) 158/2017 Learned counsel for the respondent at the outset raised an objection that Enforcement Petition would not be maintainable as the order in question is an interim order passed under Section 17 of the Arbitration & Conciliation Act, 1996 (hereinafter referred to as the 'Act') and confirmed by this Court under Section 37 of the Act.

As notice in OMP(CONT) 4/2017 has been issued, learned senior counsel for the petitioner seeks leave to withdraw the present petition, without prejudice to the rights and contentions of the petitioner. In view of the above, present petition is dismissed as withdrawn, with liberty as sought for.
