ORDER

% 29.01.2018 Learned counsel for the respondent No.2 states that an order regarding provisional release of the goods has been passed under Section 1 1OA of the Customs Act, 1962. A copy of the said order has been made available to learned counsel for the petitioner and it is stated that the original order has been sent by post. Learned counsel for the petitioners states, without prejudice to the rights and contentions of the petitioners, that the petitioners would withdraw the present writ petitions and prefer an appeal against the said order before the Customs Excise and Service Tax Appellate Tribunal ('CESTAT').

In view of the aforesaid statement made, the writ petitions are dismissed as withdrawn, with liberty to the petitioners to challenge the order passed by the respondents before the CESTAT. We clarify that the Court has not expressed any opinion on merits. There would be no order as to costs.
