% 18.07.2018 C.M.No.28052/2018 & CONT.CAS(C) 829/2017 The present petition has been filed alleging violation of the undertaking given by the respondent in HMA No.1017/2014 dated 24.11.2014 as also in HMA No.15/2016 dated 05.01.2016. Today, learned counsel for the parties jointly submit that even though the parties had initially entered into a Memorandum of Understanding (MoU) dated 16.10.2014 and thereafter an amended MoU dated 24.11.2015, whereafter a decree of divorce was granted to them on 08.01.2016, the parties were still not ad-idem in respect of some of the terms of the amended MoU. They submit that during the pendency of the present petition, the parties have amicably settled the matter and entered into a fresh addendum dated 16.07.2018, which would be treated as an addendum to the amended MoU dated
24.11.2015, a copy whereof has been filed alongwith the joint application seeking withdrawal of the present petition in terms of the addendum dated 16.07.2018.
The parties, who are present in person, undertake to abide by the terms and conditions of the aforesaid addendum, which is taken on record. The parties will remain bound by the terms of the aforesaid addendum.
In view of the aforesaid addendum, the petitioner does not wish to press the contempt petition.
For the aforesaid reasons, the application is allowed and disposed of.
The petition stands dismissed as withdrawn.
