After some hearing, the learned counsel for the petitioner submits that he may be allowed to withdraw the present revision petition with application filed therewith, though seeking liberty to approach the Additional Rent Controller with the review application inasmuch as part of the crucial material submitted in support of contentions raised as to the absence of the need of the third respondent not having been considered in the impugned order. The learned counsel submits that he may be given one month's time to approach the Rent Controller for the purpose as such application could not be filed earlier because the copy of the order came to be realised on 03.11.2017, and in the meanwhile, for protection to be accorded against execution.

The petitioner and the application filed therewith are dismissed as withdrawn with liberty to file review application within one month, hereof granted, as prayed.

The eviction order will be kept in abeyance for one month and in the event of review application being filed, it will not be enforced till the Rent Controller takes a decision thereon. R.K. q AB~ -AA- ., J DECEMBER 15, 201 7/umang RC.REV. 565/2017
