This application is filed under Order 23 Rule 3 of the CPC for bringing on record the settlement between the parties and for passing of appropriate orders.

Para 3 of the present application contains the terms and conditions of the settlement. The terms and conditions of the settlement are legal and valid.

The defendants have also agreed to suffer a decree of permanent injunction in terms of prayers (a), (b) and (c) of the plaint. Accordingly, the application is allowed.

Suit is decreed in terms of the settlement between the parties. 5.

Under section 16A of the Court Fees Act, the plaintiff shall be entitled to refund of 50% of the Court Fees.
