% 25.04.2018 W.P.(C) 11095/2017 1.
Pursuant to the order dated 19.01.2018, learned counsel for the respondents states on instruction, that the respondents have no objection to the petitioner being posted at the 316 Field Regiment, which is presently at Gurdaspur (Punjab) and shall be moving soon to Srinagar (J&K). 2.
Learned counsel for the petitioner states that his client would be satisfied with the above but as he has an apprehension that the surgery of the petitioner's son, which is now scheduled in the end of May, 2018, may have to be deferred as he is not fit and in that eventuality, the petitioner having exhausted all his leaves, orders would be required for him to be relieved for that duration by attaching him to a unit in Delhi for a period of 2-3 months. W.P.(C) 11095/2017
3.
If such a request is made by the petitioner to his Commanding officer, the same shall be considered sympathetically and appropriate orders be passed.
4.
The petition stands disposed of.
CM No.46304/2017 (Stay) Dismissed as infructuous.
