The instant writ petition under Article 226 of the Constitution of India read with Section 482 Cr.P.C. has been filed by the petitioner with the following prayer:- (i) to issue a writ of mandamus directing the respondents No.1 and 2 to provide immediate protection to the petitioner and his family members i.e. petitioner's parents and his sister all residing at E-9, Main Road, Krishna Nagar, Delhi-110051 so long the threat perceptions persist. (ii) to issue a writ of mandamus directing the respondents No.1 and 2 to take all appropriate legal action against the culprits/respondents No.3 to 5 and their companions and to bring them to justice for having been committed the serious crime and offences.

Status report has been filed by the State wherein it is mentioned that petitioner is the cousin brother of respondent No.5 Payal Makkar and that there was dispute between them over non-payment of a friendly loan. They also made various complaints against each other at PS Krishna Nagar. There was strong apprehension of breach of peace in the area, hence a kalandra under Section 107/150 Cr.P.C. was prepared against the parties vide DD No.26A dated 11th December, 2017 at PS Krishna Nagar and sent to Special Executive Magistrate, Distt. Shahdara. 3.

In the facts and circumstances of the case and in view of the status report filed by the State, the State/R-1 is directed to provide necessary protection to the petitioner and his family members through SHO concerned, after assessing the element of threat, if any. The State/R-1 shall also ensure that mobile numbers of concerned SHO/Beat Constable are provided to the petitioner to enable him to contact if necessity arises. 4.

With above directions, the writ petition is disposed of. As prayed, copy of the order be given dasti to learned counsel for the parties.
