% 12.12.2017 Learned counsel appearing on behalf of the petitioner, after some arguments, states that they would deposit 25% of Rs.18,33,192/- with the Registrar, DRAT, within two weeks from today. In view of the facts and circumstances and the decision of a Division Bench of the High Court of Judicature at Bombay in Writ Petition (L) No.2758 of 2011 titled as "M/s. Sterlite Technologies Ltd. vs. Union of India & Ors.", subject to the petitioner depositing 25% of that amount, within two weeks as undertaken, the Appeal No.291/2017 arising out of Original Application (OA) No.211/2014 (DRT-II, Delhi), is restored to the file of the learned DRAT for further proceedings, in accordance with law. List the matter before the learned DRAT for the said purpose on 04.01.2018 in the first instance. It is hoped and expected that the learned DRAT shall dispose off the appeal after ensuring that the pre-deposit, as undertaken hereinabove, has been made, in accordance with law after affording an opportunity of being heard to learned counsel appearing on
behalf of the parties.
With the above directions, the writ petition is disposed off. Pending applications also stand disposed off. SIDDHARTH MRIDUL, J S.P. GARG, J DECEMBER 12, 2017 bg
