CORAM:
HON'BLE MR. JUSTICE RAJIV SHAKDHER
O R D E R
% 19.12.2018 Issue notice.
1.1 Mr. Bhuvnesh Satija accepts notice on behalf of the respondents. Learned counsel says that while he has no objection to the prayer for extension of time, condition (s) should be imposed so that the petitioner does not delay the proceedings any further. The record shows that the learned Arbitrator entered upon reference on 01.08.2017. I am told by the counsel for the parties that based on mutual agreement, learned Arbitrator extended the period beyond the statutory period of 12 months by another six months. According to the learned counsel for the parties, the extended period is coming to an end on 14.01.2019.
2.1 Furthermore, I am informed that the matter is at the stage of arguments.
O.M.P.(MISC.)(COMM.) 402/2018
Having regard to the fact that the time and money has been invested by the parties, I am inclined to extend the period for conclusion of arbitration proceedings till 30.04.2019. It is made clear that in case parties delay the proceedings, learned Arbitrator will have the liberty to impose costs on the party delaying the proceedings. The petition is disposed of in the aforesaid terms. Pending application shall stand closed.
