O R D E R

% 30.01.2018 Counsel for the petitioner brings to my notice that a Coordinate Bench of this Court has appointed an Arbitrator to adjudicate the disputes that have arisen between the parties in relation to the Civil and Services Works Contract dated 9th May, 2015. She submits that as the Local Commissioner has already made measurements in compliance with the order dated 22nd December, 2017, the present petition may be dismissed as withdrawn.

Counsel for the respondent, however, submits that there are some issues with respect to the averments made in the petition as also to the measurements recorded by the Local Commissioner. All these issues may be taken up by the respondent before the Arbitrator so appointed by this Court.

In view of the above, the present petition is dismissed as

withdrawn.
