% 15.12.2017 After some hearing, the learned counsel for the petitioner submits that he may be allowed to withdraw the present petition and the applications filed therewith and instead approach the Tribunal with an application for review inasmuch as the contention about the availability of suitable place at 2nd floor has not been comprehended or adjudication thereupon.

The petition and the application filed therewith are dismissed as withdrawn with liberty as prayed, granted.

It is noted that the statutory period has not yet lapsed. The petitioner is given the liberty to approach the Rent Controller with the review application but must do so before the elapse of the statutory RC.REV. 568/2017

period. If review application is filed within the said period, the Rent Controller will bear in mind and consider the need to protect the petitioner against the eviction order till such time the review application is adjudicated.
