% 13.12.2017 The order dated 30.11.2017 whereby the request of the petitioner (plaintiff in the suit) for summoning additionally an official witness from Delhi Development Authority was declined by the Additional District Judge appears on its face to be cryptic not reflecting unacceptability of the reasons why, as per the submissions of the plaintiff, such evidence was crucial and relevant. The learned counsel for the petitioner, after some hearing, submits that she may be allowed to withdraw the present petition and the applications filed therewith and instead to move an appropriate application seeking summoning of the said witness so that a better CM(M) 1410/2017

reasoned order can be passed.

The petition and the applications filed therewith are dismissed as withdrawn with liberty, as prayed, granted. Dasti under the signature of Court Master.
