% 15.12.2017 Petitioners claim himself to be the owners of a portion of land in Khasra Nos.79 and 80 at Village Bhalswa, Jahangirpuri, Delhi. The land of the petitioners was acquired by the Award dated 03.02.2016. Petitioner was aggrieved as he has not been paid any compensation and the petitioner has also challenged the Award proceedings. WP(C) 7839/2009 titled Ram Prakash Mittal and Anr. Vs. Union of India was disposed of by the Division Bench on 30.9.2016. In the concluding paragraph the Division Bench had noted that the petitioners were entitled to a declaration that the said acquisition proceedings initiated under the 1894 Act in respect of the subject land are deemed to have lapsed. It is so declared. Learned

counsel for petitioner points out that pursuant to that judgment the petitioners had made an application before the Tehsildar for deletion of entries in respect of the above mentioned Award. The first application was made on 23.5.2017.

On advance notice, learned counsels for respondents have put in appearance. Learned counsel for respondent no.1 does not have any positive instructions but she states that an SLP might have been preferred against that order.

Be that as it may, in case no SLP against the order of the Division Bench (noted supra) is preferred, the application of the petitioner pending before the Tehsildar be decided expeditiously and preferably within an outer limit of eight months from today. Petition disposed of in the above terms.
