% 21.12.2017 This petition under Section 27 of the Arbitration and Conciliation Act, 1996 has been filed by the petitioner seeking issuance of summons to the Record Keeper from the Delhi High Court FAO (OS) Branch/Dealing Section with the entire record file of FAO(OS) No.261/2015 titled as "Telewings Communication Services Pvt. Ltd. vs. VIOM Networks Ltd."

The Sole Arbitrator vide Record of Proceedings dated 7th November, 2017, in case reference No.DAC/1175/04-16, had granted permission to the petitioner to approach this Court for assistance in the matter. The learned counsel for the respondent submits that the witness was to be summoned only for production of letter dated 21st November, 2012 from the above record. This will be a matter to be decided by the learned Sole Arbitrator.

In view of the above, let summons be issued to the

abovementioned witness for producing the above mentioned record before the Sole Arbitrator on 19th January, 2018 at 2.30 p.m. at Delhi International Arbitration Centre.

The diet money for the witness shall be paid by the petitioner on his appearance before the Sole Arbitrator. The petition is allowed in the above terms.
