% 10.01.2018 Petitioner has assailed the order dated 22nd September, 2017 passed by the learned Sessions Judge, which is an interlocutory order. In view of the law laid in State Vs. Navjot Sandhu (2003) 6 SCC 641, present petition is not maintainable.
Learned counsel for the petitioner has placed reliance on Bipin Shantilal Panchal Vs. State of Gujarat (2001) 3 SCC 1. The said judgment is in the context of different facts, inasmuch as, Supreme Court has taken note of Bipin Shantilal Panchal (Supra) in Navjot Sandhu (Supra), therefore, is no help to the petitioner.
Accordingly, in view of the Navjot Sandhu (Supra), present petition is dismissed. Miscellaneous application is disposed of as infructuous. A.K. PATHAK, J.
