+ CRL.M.C. 5333/2017 AMIT JAIN ..... Petitioner Through:

Mr. Ishwar Singh, Adv. along with petitioner in person.

versus STATE OF DELHI & ANR ..... Respondents Through:

Mr. G.M. Farooqui, APP for State with SI Jitendra Singh, EOW.

Respondent no. 2 in person.

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 07.02.2018 Notice could not be issued to the respondent no.2 as process fee was not filed. However, respondent no.2 has appeared in Court and accepts notice. Respondent no.2, who has been identified by SI Jitendra Singh of Economic Offences Wing, states that he has settled the matter with the petitioner vide Settlement Agreement dated 22nd November, 2017 of his own free will and without any undue force, pressure or coercion, therefore, FIR No. 117/2015 under Section 63 of the Copy Right Act, 1957 and Sections 103/104 of the Trade Marks Act, 1999 registered at Economic Offences Wing may be quashed.

Keeping in view the settlement arrived at between the petitioner and respondent no.2 voluntarily, in my view, no fruitful purpose would be

served in keeping the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms.

Dasti.
