FAO(OS) (COMM) 215/2017 Aggrieved by the order dated 24th November, 2017, the present appeal has been filed by the appellant. After some hearing, Mr. V.K. Garg, Sr. Counsel appearing for the appellant wishes to withdraw this appeal as he submits that he would approach the learned Single Judge by filing an application under Order XXXIX Rule 4 CPC. Mr. Garg submits that the entire work of the appellant has come to a standstill on all sites on account

of the impugned order and other orders passed in other two OMPs being nos. 484/2017 and 348/2017.

Accordingly, the appeal and CM. No. 45414/2017 are dismissed as not pressed.

A copy of this order be given dasti under the signatures of the Court Master as prayed.
