After argument, and at the stage of dictation of judgment, counsel for the appellant says that the appeal be disposed of as not pressed, but appellant be given time to vacate the suit premises on or before 31.03.2018. It is agreed that however if there are any arrears payable towards use and occupation charges, the same will be positively cleared within this month and future use and occupation charges every month, month by month, will be paid by the appellant/tenant to the respondent/landlord by the 10th of each month. Appellant will also clear all charges towards electricity, water, etc. till the appellant remains in possession of the suit premises. 2.

Let the appellant file an affidavit of undertaking in this Court in terms of the present order within one week and on appellant filing an undertaking in this Court and complying with the same, appellant will not be evicted from the suit premises till 31.03.2018.
