By this petition the petitioner seeks regular bail in case FIR No. 240/2017 under Sections 448/380/506/34 IPC registered at PS Vasant Kunj South.

The above noted FIR was lodged on the complaint of Ravinder and Amarjeet who alleged that Rajesh Sehrawat and Rajeev Sehrawat illegally trespassed and committed theft in the flat on the first floor purchased by them. It is the case of the complainant that after purchasing the flat, that is, D-82A, Village Nangal Dewat, Vasant Kunj, Delhi, they kept their belongings in the said flat, that is, bed, sofa set, refrigerator, LCD etc. and employed a care taker to look after the flat. The complainant received constant threats extended by the accused persons who are real brothers of the seller Krishanpal Singh, thereby compelling them to leave the flat. BAIL APPLN. 2638/2017

During the course of investigation petitioner Rajeev Sehrawat was arrested on 8th July, 2017. Despite the police custody remand no recovery of the articles could be made. The petitioner even offered to settle the matter however, no settlement could be arrived at between the parties. During investigation it is further revealed that the petitioner and the co-accused got electricity meter changed on the strength of forged documents. 4.
Be that as it may, the petitioner is in custody since 18th September, 2017 and charge sheet has since been filed. Considering the fact that the trial is likely to take some time, this Court deems it fit to grant bail to the petitioner. It is, therefore, directed that the petitioner be released on bail on his furnishing a personal bond in the sum of ₹25,000/- with one surety of the like amount subject to the satisfaction of the learned Trial Court, with further condition that the petitioner will not leave the country without prior permission of the court concerned and in case of change of address the same will be intimated by way of an affidavit before the learned Trial Court. 5.
Petition is disposed of.
