% 06.03.2018 (1) The petitioner seeks anticipatory bail under Section 438 Cr.P.C. in case FIR No.620/17 under Sections 376 IPC and Section 6 of the POCSO Act, registered at Police Station New Ashok Nagar. Status report is on record.
(2) I have heard the learned counsel for the parties and have examined the file. By an order dated 15.12.2017, the petitioner was granted interim protection and was directed to join the investigation as and when required. Undisputedly, the petitioner has since joined the investigation.
(3) The record reveals that there is delay in lodging the FIR by the mother of the victim. It has further come on record that earlier also the complainant had lodged the complaint against the present petitioner in similar circumstances and interim protection has been BAIL APPLN. 2584/2017
granted to him in the said proceedings. The order dated 15.12.2017 records that the complainant is habitual of making false complaints to extort monies and favour. It further records that there are three complaints, one in Uttar Pradesh and two in Delhi, lodged by the complainant alleging sexual offences. Status report reveals that the petitioner had filed a complaint case against the complainant and her sister under Section 200 Cr.P.C. prior to the lodging of the FIR. (4) Considering the facts and circumstances of the case, the petitioner is admitted to anticipatory bail and in the event of his arrest, he be released on bail on his furnishing personal bond in the sum of `40,000/-with one surety in the like amount to the satisfaction of the SHO/Investigating Officer with the condition that he shall join the investigation as and when required.
(5) The bail application stands disposed of.
