% 26.04.2018 The respondent in the present petition has not appeared on the matter being called out and taken up. The file of the case (226/2011/CA) has been placed before the Court for perusal by Mr. Varun Nishal counsel representing the financial commissioner before whom it is pending. perusal thereof would reveal that the matter has been hanging fire since July, 2011. Over the last almost seven years the matter was heard only on few dates, it having been adjourned on every other date either because the presiding officer was pre-occupied elsewhere or on request of the parties, mostly the respondent herein, who is the petitioner before the financial commissioner. It is noted that the matter is now listed on 31.05.2018. The petitioner herein is aggrieved by the delay because there is stay operating CM(M) 1457/2017

against him.

The proceedings ought not be allowed to become protracted. It is hoped and expected that the financial commissioner will exercise better control over the proceedings and not grant adjournments without reason or only on request and further that the matter shall be decided expeditiously. With these observations, these proceedings are closed. The record of the financial commissioner has been returned to the counsel. The petition stands disposed of in above terms. Dasti to all sides.
