Learned counsel for the petitioner submits that the learned Family Court has struck off the respondent's defence and list the case for recording the evidence of the ex parte evidence on 19th February, 2018 and therefore, this petition has become infructuous. Learned counsel for the respondent submits that the respondent is contemplating to challenge the order by which his defence has been struck off.

Learned counsel for the respondent submits that this matter be referred to the mediation.

Learned counsel for the petitioner has no objection to the reference of the matter to the medication. It is, however, submitted that the proceedings before the Family Court should be permitted to continue notwithstanding the reference of this matter to mediation. 3.

List before Delhi High Court Mediation and Conciliation Centre on 6th February, 2018 at 4.00 PM.

The Mediation Centre shall appoint a senior mediator to mediate between the parties.

The report of the mediation be sent directly to the

learned Family Court.

Notwithstanding the reference of this matter to mediation, the learned Family Court is at liberty to proceed with the matter. 6.

The petition is disposed of in the above terms. 7.

Copy of this order be given dasti to counsel for the parties under the signature of the Court Master.
