% 11.01.2018 By this petition, the petitioner seeks interim bail on the ground that the surgery of his wife is to be performed on 16th January, 2018. The petitioner had earlier also applied for bail, however, this Court declined to grant bail inter alia on the ground that no date for surgery had been fixed. Before adverting to the medical condition of the wife of the petitioner, it would be appropriate to note that the petitioner is involved in case under Sections 302/328/365/397/201/34/174A IPC registered at PS Prashant Vihar wherein the employer of the petitioner aged 80 years was found dead by her daughter and the petitioner allegedly after killing her and ransacking the house had absconded. The petitioner was declared a proclaimed offender and could be arrested only after more than one year. Considering the previous conduct of the petitioner in absconding even though the fact stated in the application that the hysterectomy of the wife of BAIL APPLN. 2630/2017
the petitioner is required to be performed, this Court finds no ground to grant bail to the petitioner. However, the petition will be taken in custody to the hospital on 16th January, 2018 with police escort in civil dress to be present at the time of surgery of his wife and brought back after 5.00 PM in evening.
The Superintendent Tihar Jail will make necessary arrangements accordingly. In case no surgery of the wife of the petitioner is performed on that date then there is no requirement to take the petitioner in custody to the hospital.
Application is disposed of.
