% 28.01.2020 CM APPL No.3326/2020 This application under Section 151 CPC is moved by the parties for taking on record the settlement agreement dated 10.10.2019 arrived at between them before the Mediation and Conciliation Centre, Delhi High Court, New Delhi. The matter has been settled between the parties in terms of para Nos.10(a) to 10(d) of the agreement. It is stated the parties have settled the dispute voluntarily without any undue influence from any one and they shall be bound by the terms of settlement as contained in the settlement agreement dated 10.10.2019.

It is also informed the name of the appellant has since been changed to Birla Carbon India Private Limited and the amount so deposited by appellant per order dated 14.01.2016 shall be released in favour of Birla Carbon India Private Limited with upto date interest. The learned counsel for the respondent has no objection to

it. Ordered accordingly.

The appeal stands disposed of in terms of settlement as above. The appellant shall be entitled to the refund of the court fees as per Court Fee Act. The pending application, if any, also stands disposed of. The LCR be also remitted forthwith.
