Pursuant to the last order of this Court dated 18th December, 2017, Mr. Tarkeshwar Nath, learned counsel who appears, for respondent No. 2 says that he has obtained instructions in the matter. 1.1 Learned counsel says that National Thermal Power Corporation shall furnish a Bank Guarantee in favour of the Respondent No1 i.e. Commissioner of Customs.

Mr. Dayan Krishnan who appears for the petitioner says that he has no objection to the writ petition being disposed of if the needful is done, albeit, within a specific time frame.

Accordingly, respondent No. 2 i.e. National Thermal Power
Corporation is directed to furnish a bank guarantee within 8 weeks from today. Pending the same, that is, respondent No. 2 furnishing a bank guarantee in favour of respondent no. 1, the interim order passed by this Court on 18th December, 2017 will continue to operate. 4.
The writ petition is disposed of with the aforementioned directions.
