IN THE HIGH COURT OF DELHI AT NEW DELHI

+ CRL.M.C. 5362/2017 MOHAN LAL & ANR ..... Petitioners Through:

Mr. Saurabh Kansal, Ms. Pallavi and Mr. Sudhanshu Tiwari, Advs.

versus STATE (NCT OF DELHI) & ANR .....

Respondents Through:

Ms. Meenakshi Dahiya, APP with SI Ramesh Kumar, P.S. Sultan Puri.

Respondent no.2 in person.

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 19.12.2017 Respondent no.2-Smt. Bhagwati is present in Court and has been identified by SI Ramesh Kumar of police station Sultan Puri. Respondent no.2 submits that she has settled the matter with her husband, that is, petitioner no.1 of her own free will and without any undue force, pressure or coercion. She further submits that she is living with the petitioner no.1 for the last one year, therefore, she is not willing to pursue the FIR any further and the same may be quashed against all the petitioners. Keeping in view that husband (petitioner no.1) and wife (respondent no.2) have started living together after resolving their differences, in my view, no fruitful purpose would be served in keeping the criminal

proceedings pending.

Accordingly, in the interest of justice, FIR No. 373/2005 under Sections 498A/406/34 IPC registered at police station Sultan Puri and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.

Dasti.

A.K. PATHAK, J.
