By this petition the petitioners seek quashing of FIR No. 88/2016 under Sections 376/377/506/34 IPC registered at PS Bajan Pura, Delhi on the complaint of respondent No.2 on the ground that the parties have settled the matter.

As per the FIR there are allegations of rape against the friend of the husband of the complainant.

Considering the serious allegations raised even if the matrimonial dispute between the parties has been settled, the above FIR cannot be quashed on the basis of compromise.

Faced with this situation learned counsel for the petitioners seeks leave to withdraw the present petition with liberty to file a petition seeking W.P.(CRL) 3537/2017

quashing of the above noted FIR on merits.

Leave and liberty granted.

6.

Petition is dismissed as withdrawn.
