1. Upon being mentioned, this appeal is taken up on the Board.

2. Mr Zoheb Hossain, learned Senior Standing counsel for the Revenue has placed before the Court the letter dated 10th May, 2019 written to him by the Deputy Commissioner of Income Tax, Circle-2(1) (2), International Taxation, New Delhi permitting him to withdraw the aforesaid appeal in view of the Resolution passed by the Competent Authority on 11th April, 2019 under the Mutual Agreement Procedure and the fact that the Assessee had given its acceptance to the said Resolution by its letter dated 25th April, 2019.

3. The appeal is accordingly dismissed as withdrawn. Pending application is also disposed of.
