O R D E R

% 29.01.2016 Crl. MA 1655/2016 (by the petitioner, to releasing him on personal bond and for waiving of the requirement of one surety) Vide this application, the petitioner is seeking release on personal bond only and to waive of the condition of one surety on the ground that despite the fact that the order was passed way back on 06.11.2015 he has not been able to arrange a sound surety. It is submitted by counsel for the petitioner that the petitioner was sentenced to undergo rigorous imprisonment for a period of ten years out of which he has already undergone more than nine years. He was granted parole by this Court vide order dated 06.11.2015 for a period of three weeks for filing SLP.

Ms Nandita Rao, ASC for the State appears on advance notice and submits that the State has no objection to release of the petitioner on personal bond, however, that should be subject to the condition that he will not leave the Union Territory of Delhi and he shall report to the concerned SHO at least twice a week. The counsel for the petitioner has no objection to the same. Under the circumstances, the order dated 06.11.2015 granting parole to the petitioner is modified to the extent that the petitioner be released on parole for a period of three weeks (which shall be counted from the date of his release) on his furnishing personal bond in the sum of Rs.

15,000/- to the satisfaction of the Jail Superintendent subject to the condition that the petitioner shall appear before the concerned SHO on every Monday of week in this intervening period. He shall give his contact number to the SHO concerned for contact purpose. He is further directed not to leave Union Territory of Delhi during this period. He is further directed to surrender before Jail Superintendent on expiry of aforesaid period of three weeks.

With above modification, the application stands disposed of. The petitioner be informed through the concerned Jail Superintendent. The application stands disposed of accordingly. SUNITA GUPTA, J JANUARY 29, 2016/rd
