% 18.01.2018 The petitioners have filed the present petition under Article 226 of the Constitution of India seeking a declaration that the Award bearing No.1/201314/DC(NW) dated 27.12.2013 with respect to the land bearing plots No.KN/B25 and KN/B-26, measuring 200 sq. yards each, comprised in Khasra no.706/606/364, Village Chowkri Mubarikabad, Anand Parbat, New Delhi is deemed to have lapsed.
Mr. Gupta, learned counsel for the petitioners does not dispute the fact that the petitioners are aware that the acquisition proceedings have already been
challenged with respect to the land bearing plots No.KN/B-25 and KN/B-26, measuring 200 sq. yards each, comprised in Khasra no.706/606/364, Village Chowkri Mubarikabad, Anad Parbat, New Delhi, of which the petitioners claim to be a licensee, by the Ramjas Foundation, the licensor in a writ petition being W.P.(C). 3386/2014, which is still pending.
In view thereof, the counsel for the petitioners wishes to withdraw this petition and submits that since the petitioner continues to be a licensee and are being disturbed from the use of property, he would seek such remedy as may be available to him in accordance with law.
The writ petition is dismissed as withdrawn.
