W.P.(CRL) 3555/2017 This petition seeks quashing of FIR No. 15/2014 under sections 498A, 406 and 34 IPC registered at Police Station-Roop Nagar pertaining to a matrimonial discord against her erstwhile husband and his relatives. The marriage between the complainant and the petitioner No.1 has been dissolved by way of a decree of divorce dated 08.11.2017. The parties have compromised all their differences by settlement deed dated 16.10.2015 whereby complainant was to receive an amount of Rs. 2 crores. The complainant is present in Court. She does not have a

counsel.

Mr. M.N. Dudeja, Advocate, who is present in the Court, is appointed as her counsel for the day. He states, upon instructions, that entire settlement amount of Rs. 2 crores has been paid to her and she does not wish to pursue her complaint and would rather look for happier times ahead in life. The parties have been identified by their counsel. The parties undertake to abide by the terms of the aforesaid settlement. Their undertakings are accepted.

In view of the circumstance that the complainant herself does not desire to pursue the complaint any further, the FIR has been denuded of its substratum and any further proceeding emanating therefrom would be an exercise in futility.

In view of the aforesaid, FIR No. 15/2014 under sections 498A, 406 and 34 IPC registered at Police Station-Roop Nagar and the consequential proceedings emanating therefrom are hereby quashed. The petition stands disposed off in the above terms. NAJMI WAZIRI, J DECEMBER 19, 2017 RW
