O R D E R

% 22.12.2017 By this petition, the petitioner had sought parole for the treatment of his father and to look after his daughter who got burn injuries. Learned ASC on verification yesterday pointed out that the daughter of the petitioner has since passed away on 5th December, 2017. The previous conduct of the petitioner is unsatisfactory for the reason when he was granted parole from 18th May, 2015 to 15th June, 2015 for a period of four weeks by this Court, he jumped the parole and was rearrested only on 19th September, 2017. Besides the petitioner is also involved in two other cases, the sentence whereof has already been concluded. As per the nominal roll in the present case the petitioner has undergone sentence of rigorous imprisonment for nearly a period of 2 years 9 months and the remaining sentence is around 4 years 2 months. Considering the fact that the daughter of the petitioner has passed away this Court directed the State to verify whether the petitioner's wife Ms. Radhika Pundhir would stand surety for her husband and whether she has control over the petitioner or whether she would be in the position to control the activities of the petitioner, a status report has been filed after verifying this fact from the wife of the petitioner.

Considering that the daughter of petitioner has died due to burn injuries, this court deems it fit to grant parole to the petitioner for a period of four weeks from the date of his release on the petitioner furnishing a personal bond in the sum of ₹25,000/- with the two sureties of the like amount, out of which one surety would be of the wife of the petitioner subject to the satisfaction of the learned Trial Court, further subject to the condition that immediately on release on parole the petitioner would attend PS Karawal Nagar and thereafter on every Monday at 4:00 PM till he surrenders to custody before Superintendent Tihar Jail. Petition is disposed of.

Copy of the order be communicated to the petitioner through Superintendent Tihar Jail.
