Mr.Jethmalani, on instructions, presses only prayer Clause (1). 2.

Accordingly, issue notice. Mr. Jain accepts notice on behalf of the respondent.

2.1 Learned counsel for the respondent says that he does not wish to file a reply as only first prayer is pressed which is for extension of time. 3.

The record shows that the learned Arbitrator was appointed vide an Office Order no.322 dated 30.11.2017.

3.1. I am informed that the letter of appointment was received by the learned Arbitrator only on 13.12.2017.

Consequently, the statutory period of 12 months under Section 29A of Arbitration and Conciliation Act, 1996 would expire on 12.12.2018. 5.

The first prayer made in the petition seeks extension of the time by O.M.P.(MISC.)(COMM.) 385/2018

another six (6) months, i.e. upto 13.5.2019.

5.1 Since Mr. Ramesh Singh, learned Standing Counsel, says that he has no objection to the prayer made, as noted above, and given the fact that the parties have invested time and money in the arbitration proceedings, I am inclined to grant the prayer.

5.2 Accordingly, the relief sought in prayer clause (1) is allowed. The petition is disposed of in the aforesaid terms. Pending application shall also stand closed.
