CORAM:

HON'BLE MS. JUSTICE MUKTA GUPTA

% 11.08.2016 By this petition, the petitioner seeks anticipatory bail in case FIR No. 287/2015 under Sections 376/420/323/342/120B/377/498A/495 IPC registered at PS Anand Vihar.

The allegations against the petitioner in the above-noted FIR are that parents of complainant came in touch with the petitioner at the matrimonial website Shadi.Com wherein he claimed that he was working in London and was unmarried. After some chats, the parents of the complainant agreed for marriage. Marriage was performed as per desire of petitioner and his family members. Two days prior to the marriage, the petitioner stayed at the house of complainant and after taking drink in the evening he entered in her room and without her consent, committed rape on her. After marriage, the complainant was ill treated and harassed for demand of expensive car and

directorship in the company of complainant's father. The complainant was thrown out of matrimonial home number of time whereafter the petitioner would apologise and take her back. Later the complainant came to know that when the petitioner performed marriage with the complainant, he was already married which fact he did not disclose at the time of marriage. The factum of earlier marriage of the petitioner with Vijeta Kapoor has already been verified. Considering the facts and circumstances of the case, I do not find it to be a fit case for grant of anticipatory bail. Petition is dismissed.
